A permit is required before cremation

In Utah, a cremation cannot take place until the proper authorizations are in place. Your cremation provider obtains the Utah cremation permit and, when required, clearance from the Office of the Medical Examiner. Because cremation is irreversible, this step exists as a safeguard and is never rushed.

This is part of why cremated remains are typically returned to the family within about 7 to 10 days, rather than immediately.


Who can authorize a cremation

Utah law sets an order of priority for who may authorize a cremation — generally beginning with a surviving spouse, then adult children, then parents, then other next of kin. If someone made their wishes known through a pre-arrangement, that can guide the process as well.

The death certificate

The death certificate is completed with the certifying physician or the medical examiner and filed with the Utah Office of Vital Records and Statistics. The funeral provider typically handles this filing. Families should request several certified copies — you'll generally need them for life insurance, bank and retirement accounts, property transfers, and Social Security.
